This online store (henceforth the Service) is available for any user, for his/her own consumption, and subject to the following terms and conditions: these Conditions of Use and Contracting (henceforth CUC), our Privacy Policy and Cookie Policy.

By using the Service, you accept these CUC and the rest of our terms and conditions.

You thereby promise not to use this website for illegal purposes.

On the other hand, you are hereby informed that, for legal purposes, we store the electronic documents used to formalise purchases. You can access the aforementioned documents at any time, emailing your request to info@belafurtiva.com

3.- Description of the Service

By means of the Service, Bela Furtiva enables the purchasing of products in its online store.

The contract between Bela Furtiva and the purchaser is available in Spanish, Galician or English.

The process for purchasing in the online store is as follows:

After selecting the products, these are added to the shopping basket.
After completing the selection, you then fill in the requested data (either as a Guest or as a Registered User): personal, shipping, or delivery option, payment method and acceptance of the terms and conditions of the Service.
A summary of the selected articles is shown, as well as the personal, shipping and payment details, and the option of confirming the purchase.
The purchase formalisation document is stored in your profile for consultation. In any case, you can always request a copy by emailing bela@belafurtiva.com.

During the purchasing process, you can modify the selected products, the number of units, the particulars, the payment method and delivery system. In order to do so, you have to go back or click on the “Edit” option during the purchasing procedure, before finally accepting the purchase.

After completing the purchase, a confirmation email is sent within 24 hours to the indicated address. The email indicates the purchased products, their price, applicable taxes, shipping expenses, payment method or delivery address and time, as well as the applicable terms and conditions.

If you register, you can easily access your Orders and edit both your particulars and account details in your personal area.

The Service may send you links to other websites.

Bela Furtiva does not control their websites or their content, which are subject to their own terms and conditions. Therefore, BELA FURTIVA is not responsible for the quality, truthfulness or accuracy of these websites.

5.- Age

You declare that you are of legal age and legally competent to enter into this agreement and use the Service in accordance with these CUC, which you completely understand and acknowledge.

You declare that all the information provided in order to access the Service, before and during its use, is true, complete and accurate.

6.- Copyright and patent law

The content and information of the Service (including data, text, sound, image or computer code), as well as the infrastructure used to provide the said content and information, is either owned by BELA FURTIVA or it is authorised to use such.

In addition, it is forbidden to modify, reproduce, duplicate, copy, distribute, sell, resell or exploit in any other way the Service for commercial or similar purposes.

Any other use of the Service’s content requires our prior consent in writing.

7.- Product delivery and availability

Purchased products will be delivered within 6 to 8 weeks, from the formalisation of the order.

If the purchased product is not available, you will be notified and, if possible, you will be informed of the possibility of a product of similar characteristics, for the same price, with the same or superior quality. In any case, if you prefer to cancel the purchase, you will be refunded within 30 days.

The date of delivery at your address will depend on the availability of the selected product or shipping area. The delivery time can also vary according to each order’s specific circumstances, especially in the case of extraordinary transport incidents and difficulties in delivering the merchandise.

In any case, remember that deliveries are made every day of the week, except Saturdays, Sundays and public holidays in the place and/or country of destination. Moreover, deliveries are made during business hours.

The order will be considered delivered whenever the transport company delivers the package to the indicated address and you sign the delivery reception document. You are responsible for verifying the condition of the merchandise on receiving it and indicating any anomalies in the delivery note (otherwise, no claims will be accepted for shipping damage).

8.- Price and taxes

The prices of the products sold by BELA FURTIVA are indicated in euros (€), plus the applicable Value Added Tax (VAT) at the time of purchase.

In any case, the operation may or may not be tax free according to your country of residence or purchaser status. Therefore, in some cases, the final price of the order may change with regard to the indicated amount.

In the case of purchases made by individuals eligible for tax free shopping, they should indicate this when they fill in their particulars or before purchasing by emailing their ID/VAT No. to bela@belafurtiva.com, thereby enabling them to purchase tax free.

Shipping expenses are indicated during the purchasing process and when the purchase is confirmed.

11.- Right of cancellation and returns

You can return a product up to 30 calendar days after its reception.

You can cancel your order at any moment, free of charge, as long as you notify us before the order is handed over to the delivery company. Otherwise, you will have to wait until you receive the order before exercising your right of cancellation.

In order to exercise your right of cancellation, you must email your request to bela@belafurtiva.com, indicating your express decision to cancel your contract. You should return the merchandise in its original packaging along with the delivery note.
Although it is not compulsory, you can use the cancellation form provided by downloading it at the end of these Conditions of Use and Contracting.

If you exercise your right of cancellation, we will refund the amount received for this order within 14 calendar days. You will be refunded using the same payment method used for the initial transaction, unless you specifically indicate otherwise. We can withhold the refund until we receive the products or you present proof that they have been returned.

You can return any article that you bought from BELA FURTIVA as long as the products have not been used or installed, are still sealed or in their original packaging, with any manuals, accessories or gifts that were included, and the returned products do not form part of the list of articles that are not eligible for cancellation, as stipulated in the applicable regulations.

To make it easier for you to return your merchandise, we offer you the possibility of using our transport service, although you will have to pay for the delivery expenses. If you decide to contract a different service, you will be responsible for any deterioration or damage to the returned products, and will have to pay the price of any products that are too damaged to be resold.

You will only be responsible for the decrease in value of articles that have been handled inappropriately, in view of their nature, characteristic or functioning.

On the other hand, if you have received the wrong product by error, we will collect it without any additional charge and send you the correct product.

Finally, if you receive a product that is broken, damaged or in bad condition, BELA FURTIVA will collect it at your address and replace it with another one in good condition, without any additional charge.

Cancellation form model

At the end of these Conditions of Use and Contracting, you will find a Cancellation Form that you can use to notify us that you want to cancel the contract.

12.- Validity of products

BELA FURTIVA aims to guarantee that the products offered by the Service will be available for purchasing as soon as they appear in the catalogue of products, which can be viewed in the online store. However, as mentioned above, if the purchased product is not available, you will be notified and if possible, provided with a product of similar characteristics and the same or superior quality at no extra charge. If you prefer to cancel the purchase, you will be refunded within 30 days.

In any case, BELA FURTIVA reserves the right to modify the Service as it considers necessary, being able to make any changes to the products and services at any time. The images of the products and services published on our website are merely illustrative.

The purchased products may experience minor changes in their components, characteristics or features, as long as this does not affect the advertised qualities and features.

In the same way, the product information may contain typographic inaccuracies or errors, which may be changed, corrected or eliminated at any time, without these being binding with regard to the Service.

The prices that appear on the website are subject to change. BELA FURTIVA reserves the right to change the prices without prior notification. In any case, after confirming the order, the prices included therein will not be affected.

You are also informed that, despite the prices of the Service being updated, these may contain errors. We will correct any errors that appear as soon as possible, and these will, in no case, be binding with regard to the Service.

13.- Guarantees

The products are covered by a legal, two-year warranty against any non-compliance, in accordance with applicable legislation.

As a consumer, you are therefore entitled to submit a claim to the BELA FURTIVA company for any non-compliance that exists at the moment the product is delivered, within the established periods of time and conditions.

In the case of any non-compliance with regard to the purchased product, you should contact us as soon as possible, sending an email to bela@belafurtiva.com that explains your dissatisfaction and attaching photographs of the product.

If the product’s non-compliance appears during the first six months, the fault will be understood to have existed when the product was delivered, unless the contrary is demonstrated or this presumption is incompatible with the nature of the product or with the type of non-compliance.

If the non-compliance appears after the first six months, you will have to demonstrate that the defect was present at the time of purchasing, in order to be covered by the legal warranty.

You are obliged to report possible defects and non-compliance within two months of detecting such.

In the case of non-compliance, we will proceed, at our own expense, to remedy the problem by repairing/replacing the product or reducing its price, as stipulated by existing legal provisions.

Remember that you must present your purchase invoice in order to benefit from the warranty.

In any case, you are guaranteed all legal rights currently in force as a consumer and client.

The guarantees provided by BELA FURTIVA with regard to all of its articles are subject, in general, to their domestic use. BELA FURTIVA will be exonerated, and you will not be entitled to claim civil responsibility compensation, in the case of damages caused by the incorrect use of the articles or by their use for inappropriate purposes.

You should place and use the articles purchased from BELA FURTIVA in a suitable location, in accordance with their characteristics. BELA FURTIVA is not liable for any possible claims derived from the incorrect use or location of an article.

We may update the Service’s terms and condition in the future, informing you of such on our website and/or by email.

If any clause included in these CUC is declared, either partially or entirely, to be null or void, this will only affect the said provision or the part of it that proves to be null or void. The rest of the CUC will remain in force, while the said provision, or corresponding part of it, will be excluded.

16.- Claims and actions derived from the contract

This contract is governed by Spanish legislation.

In order to simplify the solution of civil claims, we do not exclude the possibility of subjecting ourselves to Equitable Arbitration before an Arbitration Court of the Chambers of Commerce and Industry.

In this regard, in accordance with applicable regulations, BELA FURTIVA informs you of the existence of an online European platform for solving disputes, which facilitates out-of-court settlements in the case of such disputes, regarding online contracts between consumers and Internet service providers. The said platform can be accessed by means of the following website: http://ec.europa.eu/odr

BELA FURTIVA’s contracts with consumers will be considered to have been made at the purchaser’s address.

Contracts made with professionals as part of their professional activity, will be considered to have been made at the seller’s address

The Service’s terms and conditions are available in Spanish, Galician and English in order to facilitate their understanding. However, in the case of any contradiction among the three, the Galician version will take precedence.
